Terms of Use

These Terms of Use govern access to and use of the Arborized site and study platform. By creating an account or using Arborized, you agree to these Terms and to the Privacy Policy.

1. Who offers Arborized

Arborized is operated by Plano Marketing LLC, a limited liability company organised under the laws of the State of Florida, United States.

In these Terms, "Arborized", "we" and "our" refer to that company. "You" refers to the person who creates an account or uses the platform.

2. What Arborized is

Arborized is a platform built on a method for studying and building knowledge.

You can use it with material you are studying or intend to study, to select what matters, mark and annotate it, record ideas and questions, research and expand concepts with the help of artificial intelligence, connect subjects to each other, build your own indexes and review what you have learned.

Arborized is designed for study sessions on a computer and runs in the compatible browsers the platform indicates.

Features, technical compatibility and functionality may change as the product develops.

3. Who can create an account

Arborized is intended for people aged 13 or older. By creating an account, you confirm that you meet that requirement.

This limit exists because the United States Children's Online Privacy Protection Act (COPPA) applies to children under 13. Arborized is not intended for those children and does not collect their data.

If an account is identified as having been created by someone who does not meet the minimum age requirement, access will be blocked and the associated data will be deleted, in accordance with the Privacy Policy and applicable law.

4. A free service, and possible changes

Arborized is currently offered free of charge.

We may change, add or remove features, set usage limits, introduce paid plans, or discontinue part or all of the service.

If using Arborized comes to require payment, the applicable conditions will be presented before any charge is made. Previous use of the platform, whether free or paid, does not grant permanent free access or any acquired right to future features.

Where a change would remove data, or where the service is discontinued, we may provide, whenever reasonably possible, a period for you to export the supported data before deletion.

5. Your account

Your account is personal and non-transferable. Do not share your login and password, for the security and the confidentiality of your own material.

The email address you provide must be valid and accessible to you, as it is used for account confirmation, access recovery and communications related to the service.

If you believe another person has gained access to your account, change your password.

6. Material used in Arborized

You may use Arborized with material you have the right to use, such as books, tests and exercises, class notes, PDFs, articles, images, videos and other study material.

Arborized does not provide that material and grants you no rights over third-party works or content. You are responsible for using it in accordance with applicable laws, licences and rights.

Arborized is not a service intended for the distribution or public availability of third-party works.

Depending on the feature used, information related to the material may be processed on your own device or by systems used to provide the service. How files, excerpts and other data are processed, transmitted, stored or deleted is described in the Privacy Policy.

7. The content you create

The marks, notes, questions, answers, summaries, indexes and other records you create in Arborized belong to you.

So that the platform can work, you grant us a limited, non-exclusive and revocable licence to store, process, display back to you and organise that content, solely for the purpose of providing the service.

We do not sell your content, do not make it available to other users, and do not use it for advertising purposes.

8. Use of artificial intelligence

Some features, such as expanding a concept and looking up a word, use artificial intelligence services provided by third parties. To do so, the selected excerpt and the information needed to process the request are transmitted to those services.

What is transmitted, what is never transmitted under any circumstances, and which providers are used are set out in the Privacy Policy.

Responses generated by artificial intelligence may contain errors, omissions or outdated information, and should be verified by you before any use.

9. What you may not do

When using Arborized, you agree not to:

• use the platform for any unlawful purpose;
• access, or attempt to access, another person's account or Arborized systems without authorisation;
• copy, reproduce, resell, licence or commercially exploit the platform, in whole or in part;
• use automated means to create accounts, extract content or overload the service;
• put material into the platform that you do not have the right to use;
• interfere with the operation of the service or circumvent technical and usage limits.

10. Suspension and termination

We may suspend or terminate access for an account that breaches these Terms, that presents a risk to the security of the service or to other users, or that does not meet the age requirement in clause 3. Where reasonable and appropriate, you will be informed beforehand.

You may close your account at any time, through the platform itself, without giving a reason.

11. No warranties

Arborized is provided "as is". We do not warrant that the service will be uninterrupted, error-free, secure against every failure, or compatible with every device and configuration.

We make no promise of any study outcome, academic performance, grade or result. Arborized organises and preserves the work you do; the studying is yours.

12. Limitation of liability

To the maximum extent permitted by applicable law, Arborized is not liable for indirect, incidental, special or consequential damages, including loss of profits, loss of opportunity, loss of time or loss of data.

You are responsible for keeping copies of whatever you consider important. The platform provides full export of your content, as set out in clause 13.

13. Exporting and deleting your data

At any time, you may:

• export your content as a single file, with nothing being removed; and
• delete your account, which permanently removes the content associated with it.

Deletion cannot be undone. Export first if you want to keep anything.

We assume no obligation to retain your content indefinitely. Retention and deletion periods are dealt with in the Privacy Policy.

14. Arborized's intellectual property

The Arborized name, its visual identity, its site, its software, its documentation and the implementation of the method in the platform belong to Arborized and are protected by applicable law.

These Terms transfer no rights over those elements to you, beyond the right to use the platform as set out here.

15. Changes to these Terms

These Terms may change. Where a change is material, you will be informed by email or through the platform before it takes effect. Using Arborized after the new version takes effect means you agree to it.

16. Governing law and venue

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law rules. The courts of Polk County, Florida, are the agreed venue for any dispute.

The English version of these Terms is the official version and prevails over any translation.
